Subject: Trademark Infringement Protect Your Business Name
Dear Xxxxxxx Xxxxxxx,
I hope this email finds you well.
We are reaching out regarding a critical matter concerning the trademark application for “Xxxxxx Xxxxxx” Another party has recently approached us to file a trademark application for this name. Upon conducting thorough research, we found that they are a new startup and have been using the name for only a few months.
In contrast, our research indicates that you have a legitimate and proven history of using this name for an extended period. As per our company policy, we are giving you first priority to file for the trademark, as your claim to the name is significantly stronger.
Here’s what you need to know:
- If you wish to proceed: We can file the trademark application through IP Australia immediately, ensuring you secure exclusive ownership and protection of the name.
- If you choose not to proceed: We will move forward with the other party’s application, as IP Australia operates on a first-to-filebasis. However, we strongly advise against this, as it could lead to serious legal and operational consequences for your business.
If the other party secures the trademark, they will obtain exclusive rights to the name, and you may no longer be able to use it freely. Under the Trade Marks Act 1995, this could expose you to potential trademark infringement claims. You could face:
- Cease-and-desist orders, requiring you to stop using the name.
- Rebranding costs, including changes to your business name, marketing materials, and digital presence.
- Legal action, which could result in penalties, damages, or injunctions.
We strongly recommend acting swiftly to secure your rights and avoid the risk of a legal battle. The first-to-file principle means we cannot delay filing indefinitely.
If you would like to proceed, please let us know as soon as possible so we can begin preparing your trademark application. Should you have any questions or need further assistance, feel free to contact us via this email or call our front desk at +61485860369 and ask to be connected to me directly.
Thank you for your prompt attention to this matter. We look forward to assisting you in protecting your business.
Thanks & Regards,
